11 March 2010 - UAE launches Statutory Regulations for Large Private Yachts

The United Arab Emirates (UAE) recently unveiled at the Gulf Superyacht Forum (GUSF) 2010 its new Large Private Yachts UAE Statutory Regulations. The UAE announced that its National Transport Authority (NTA) is using the class society DNV (DetNorske Veritas) as a recognised organisation to develop these regulations for private yachts under their flag. The regulations will apply to vessels above 24 metres, with no limit to the number of passengers and operating in areas including coastal, deep ocean and polar.

According to Captain Saleem Alavi of the NTA, speaking at the GUSF, this new initiative will have goal based, rather than proscriptive requirements. The UAE submitted the regulations to the International Maritime Organisation (IMO) in 2009 and circulated the details to IMO member states for recognition. Karl Morten Wiklund, of DNV, said “that other states may like to apply the UAE regulations for their registry. Then UAE [would] provide the unified interpretations”.
 
The UAE claim that this is the first set of such regulations specifically covering private yachts over 24 metres. According to Captain Saleem one of the key features of the system is to allow the UAE code to accommodate the design innovations and peculiarities of the superyacht industry, the so called “functional requirements”. Speaking at GUSF, Johan Valentijn, of Abu Dhabi Mar whose Swift 141 is being built to these rules, said one of the key principals of the new rules is to create “something that is much more dynamic and goes with the times and doesn’t deal with things that happened a hundred years ago or fifty years ago”. For example, the regulations are said to allow for the inclusion of shadow & support vessels, which can be certified as a yacht.
 
This new move was said, at GUSF, to be intended to attract yachts not only the UAE flag, but also the wider region. It will also offer a viable alternative to UAE based ship owner, with Captain Saleem stating that only 61 out of 1076 currently register their vessels with the UAE – something it wishes to change.
